2007 Home Invasion Robbery (VOP) St. Lucie County
Facts: Our client was placed on probation after serving a 15 year sentence for Home Invasion Robbery. Several months after his release he was stopped by law enforcement for an alleged traffic violation. During the traffic stop the officers removed our client from his vehicle to conduct a dog sniff. The dog alerted to the vehicle and a search was conducted on the vehicle. As a result of that search drugs were found and our client was charged with drug trafficking, which subsequently violated his probation.
Results: Upon reading the arrest affidavit for the new arrest we immediately felt there was a violation of our client’s rights. We reviewed all discovery and paperwork from the resulting arrest. We then scoured through all available body camera footage and scheduled depositions of all officers involved in our client’s arrest. Once having everything we needed we filed a motion to suppress all evidence in both the new case and the violation of probation. Before the hearing the state dropped the new case and agreed to a dismissal of the violation of probation.
