2022 VOP Battery on Elderly (St. Lucie County)

Facts: Our client was arrested for battery against her parents, who are over the age Is 65. She was sentenced to probation with the condition of completing a treatment program. And was wrongly discharged early and when faced with the disappointment she used and violated her probation. This is when we got involved. She was in custody with a violation of probation and a new battery on her parents.

Result: After meeting with our client we immediately knew that while our client was in need of substance abuse treatment, she was also suffering from mental health issues that were going untreated. We got her evaluated which revealed a diagnosis of PTSD. We took this information and our clients willingness to participate in appropriate treatment to the state attorney. Despite our client scoring a prison sentence we were successful in getting our client into appropriate treatment on probation.
