Domestic Battery (Pinellas County)

Facts: Our client was accused of striking her fiancé in the case during an argument. The fiancé contacted 911 in order to deescalate the situation and our client was arrest for battery.

Results: Our client’s fiancé did not intend to pursue charges and did not wish to see our client punished further. He contacted us immediately about what we could do to assist. We filed out notice the very next day after our client’s arrest. We also contacted the state attorney’s office by sending a letter detailing the fiancé’s wishes along with a notarized affidavit that he did not wish to pursue this case any further. Due to our immediate contact with the state attorney’s office and our diligence in following up and advocating to them for our client the state decided not to pursue the charges. Our client never even had to attend court.
