DUI (Indian River County)

Facts: Our client was out one night and was assaulted outside of a bar. She called 911, but not pleased with the way law enforcement handled the matter as no arrest was made and the officers left. She drove off and continued to call 911 to ask for assistance and complain about the lack of professionalism of the officers who responded. While on with dispatch they were tracking her location and had her stopped by another agency to ensure she was safe to drive. At that time our client continued to express her anger and the officer asked her to perform field sobriety exercises. She was ultimately arrested and charged with DUI. We immediately requested the body camera footage and the 911 calls regarding both the original incident and the traffic stop. It was clear to us that our client was angry and upset more than anything by watching the video. After thoroughly reviewing the case we decided to set the case for trial. Prior to the trial and after explaining our position to prosecutor, the state offered to resolve the case with a reckless driving to avoid the DUI conviction. However, our client was a CDL holder and would have points assessed on her CDL which could result in her losing her only source of employment. After rejecting the offer of a reckless driving the state came back and offered her a withhold of adjudication and a fine on a disorderly conduct. Our client will be eligible to seal this and there will be no implications on her CDL.
