Home Invasion Robbery (St. Lucie County)

Facts: Our client was charged with breaking into a home with his brother. While in the home he is alleged to have tied up the 3 women in the home, ransacked the house and stole all of the narcotics prescription drugs, their phones, and all their cash. This is said to have taken place over several hours. The investigation revealed that our client’s DNA was on several items found in a wooded area leading away from the crime scene. Phone records were obtained for our client which show that his phone was not in use and appears to have been left elsewhere during the time of the robbery.

Results: Our client was adamant from day 1 that he did not commit this crime. His codefendant, who is also his brother, testified against him at trial. We were able to cross examine the brother and both of the victim’s at trial on the inconsistencies in their stories. We got the DNA expert to admit that DNA can appear on an item after being transferred from another item. And, at the end of a 3 day trial our client was found not guilty on all 7 counts, 5 of which were subject to a life sentence.
