Injunction Defense (St. Lucie County)

Facts: Our client bought and moved in to a condo on the beach. But, just weeks after moving in they began to smell marijuana coming from the floor above them. It became so bad that they could no longer ignore it and reached out to their neighbor to ask them to stop. When that did not work they began to seek help from the board of the condo association. However, that did not produce results either so our client continued to respectfully request their neighbor to cease their smoking habits and even offered alternative locations where smoking is permitted in the community. Rather than stopping the behavior the neighbor filed an injunction against stalking against my client. We took the case to hearing and were able to show that my client was not acting irrationally or out of line. The injunction was denied and our client was free from having a restraining order on his record.
