Lewd and Lascivious Molestation (Indian River County)

Facts: Our client was accused of committing lewd acts on his girlfriend’s very young daughter. The allegations were 3 years old at the time the alleged victim came forward and the circumstances seemed very suspicious to us. Very early on we knew we would be needing an expert witness to assist in explaining a lot of our concerns to a jury. We also utilized the doctor’s assistance in preparing for depositions. Ultimately, our persistence and belief in our client’s innocence led the state to make him an offer he could not refuse. The original charges carried a possible life sentence, but we were able to secure a plea to the reduced charge of child abuse, which carries a maximum of 5 years in prison. Our client was placed on 5 years of probation and sentenced to the time he had already served. Our client will get to be home for the holidays this year because our team never gave up on this case no matter the allegations.
