Organized Scheme to Defraud and Grand Theft (Martin County)
Facts: Attorney Whitney Duteau was retained to represent her client on a case out of Martin County while he was incarcerated in the St. Lucie County Jail on separate charges. After speaking with her client she learned that he may have been booked on the warrant out of Martin County but held in St. Lucie due to the pending charges in St. Lucie. She immediately got right on it and did a public records request to get all the booking information and every arrest affidavit for her client in that time frame. She was able to confirm that her client had, indeed, been booked in on both the Martin County Case and the bond revocation on the St. Lucie case. Based on this information she was able to file a motion to discharge the case against her client in Martin County because no formal charges were filed and no court date given within the statutory speedy trial period. This motion led to all charges in Martin County being no filed without the need for a hearing and her client was released from all bonds and pre-trial conditions.
